É possível que exista dinheiro na mesa que os Municípios estejam deixando de direcioná-lo aos seus cofres.

 Antes de prosseguir é preciso entender que não se trata de uma fórmula mágica, mas sim de simples ações que podem aumentar significativamente a entrada de recursos no caixa do Município.

Vamos lá. 

Esses recursos advindos da retenção do imposto de renda nas contratações de pessoas jurídicas, além do já exposto, contribuem, por exemplo, com a melhora do índice da folha de pagamento, que nos Municípios não pode ser superior a 60% da Receita Corrente Líquida (54% para o Executivo e 6% para o legislativo).
A melhora no fluxo de caixa originada da entrada de recursos através da correta retenção está mais perto e mais rápido do que você possa imaginar.

Em um destes Municípios a arrecadação saltou de 500 mil reais para mais de 5,8 milhões de reais somente com o IRPJ;
2 – Em um grupo de apenas 10 notas fiscais analisadas por mim em um Município, constatou-se que o recurso financeiro que poderia ter ficado no caixa da Prefeitura, a título de retenção do IRPJ, seria 25,79 vezes maior daquele que realmente foi retido, caso a retenção tivesse ocorrido da forma correta. 

TAMANHO DA OPORTUNIDADE
Os dados apresentados são reais e seu Município pode estar deixando de obter recursos importantíssimos.

De acordo com o já observado na prática e após a análise de inúmeros documentos fiscais, reter com base apenas no que foi colocado pelo fornecedor na nota fiscal é insuficiente para a correta retenção.
É possível que os documentos fiscais emitidos pelos fornecedores ao seu Município, contenham erros e impropriedades, e o mais comum está relacionado a alíquota informada na nota fiscal para efeitos de retenção.

Dê uma pausa na leitura e pegue algumas notas para verificar o que falaremos a seguir.

Espero que já esteja com algumas notas fiscais dos fornecedores na mão, vou considerar que sim.
Os documentos fiscais, por vezes, apresentam alíquotas de 1% ou de 1,5%, ou ainda sem informação de alíquota.
Confira aí.
Essas alíquotas de 1% e 1,5% não são as alíquotas aplicáveis quando da contratação de fornecimento de bens ou serviços pelo seu Município. 

As alíquotas corretas para a retenção do IRPJ pelo seu Município são diferentes das citadas no parágrafo anterior, podendo chegar a 4,8%.

EXEMPLO
Já pensou se seu Município paga R$ 100.000,00 sem reter o IRPJ em razão do fornecedor não ter informado a alíquota no documento fiscal, sendo que nessa operação, neste exemplo, a alíquota a ser aplicada deveria ser a de 4,8%?
Neste caso o Município amargaria um prejuízo de R$ 4.800,00 em apenas uma única nota.

VOCÊ SABIA?
A cada R$ 100.000,00 reais pagos a título de obras ou serviços relacionados à construção civil o Município tem direito a reter e recolher aos seus cofres importâncias que vão de R$ 1.200,00 e R$ 4.800,00.

REFLITA
Qual o valor que está sendo retido, a título de IRPJ, no seu Município, a cada R$ 100.000,00 nas contratações relativas à Construção Civil?
O percentual retido é de 1,2% a 4,8%?
Possívelmente esse percentual de 4,8% seja maior que a alíquota do ISS no seu Município, ou seja, pode ser arrecadado mais com o IRPJ do que com o ISS na contratações envolvendo alguns tipos de serviços. 

ATENÇÃO. Não é possível reter o IRPJ apenas nos serviços contratados pelo Município, mas também é possível fazer a retenção quando da contratação do fornecimento de bens. 

DO EMBASAMENTO PARA A RETENÇÃO
O direito de retenção do IRPJ nas contratações do Município já foi decidido pelo STF (Tema 1.130), onde foi decidido pela corte suprema que a titularidade desta receita é do Município.
Este direito também está ancorado na Constituição de 88.
Após todas as explanações deste texto talvez você ainda deva estar se perguntando:
